With the help of the program, which started working on August 22, at least 1.3 thousand more mortgage borrowers will be able to restructure their debts. The state has allocated 2 billion rubles for these purposes, Alexei Nidens, managing director of the Agency for Housing Mortgage Lending (AHML), said at a press conference at the Rossiyskaya Gazeta media center.

Last time, by the way, 4.5 billion rubles were spent to support mortgage borrowers - that is, twice as much as is planned now. And this is not the only difference of the new program. The previous one lasted two years, now the period is not specified - everything will end with the exhaustion of funds. In addition, the state has adjusted the conditions for citizens to receive mortgage assistance.

Families with minor children and children under 24 who study full-time at universities can become participants in the program. Also, the state can help the disabled, parents of disabled children and war veterans - all those who belong to social categories and whose assistance from the budget is really justified.

In addition, all applicants for state support must meet a number of other criteria. In particular, the mortgage apartment should be the only housing. And its size still matters. So, the area of ​​\u200b\u200bone-room apartment should not exceed 45 square meters. That is, the state will not help restructure the mortgage received for an elite cottage. However, it is allowed to have an aggregate share of the borrower's family members in the ownership of another dwelling (but only one!). To confirm the rights to other housing, the borrower does not need to provide information from the Unified State Register of Real Estate. AHML will do all this for him.

In addition, assistance can be provided only if at least a year has passed from the date of obtaining a mortgage loan to the date of filing an application for restructuring, and monthly payment on a loan increased by at least 30 percent of the amount that a person gave to the bank at the conclusion of the contract. By the way, it was precisely because of the last point that the discussion flared up: they say, state support has shifted towards foreign currency mortgages. After all, for "ruble" mortgages, the size of the payment does not jump so much, which means that such borrowers may not wait for help on problem debts.

Aleksey Nidens stressed that mortgage lenders who have taken a loan both in foreign currency and in rubles can apply for participation in the program. And if the amount of the monthly payment on a foreign currency loan may increase due to exchange rate fluctuations, then in the case of a ruble mortgage, we are talking about loans with a floating rate or when mortgage insurance is waived. In all other situations, the decision to provide assistance will be made by a special interdepartmental commission. It can positively resolve the issue of supporting citizens who do not even formally meet the conditions of the program, but are in dire need of assistance. It is expected that the commission will start working in September.

The final decision to provide support is still made by the creditor bank. Because, as Niedens noted, the bank knows its borrower better, financial position at the time of signing the contract, can assess the payment discipline.

Now AHML has signed agreements with hundreds of banks. However, financial ombudsman Pavel Medvedev draws attention to some of the rough edges of the program. Under the new rules, the bank must agree to a rate of 11.5 percent (if the loan is issued in foreign currency). If the bank requires, say, 12.5 percent, the person will not receive support. New rules for the state program to help mortgage borrowers in difficult financial situations came into force in Russia on Tuesday, August 22.

The assistance program for mortgage borrowers was launched in April 2015: banks restructured problem mortgages at a rate of no more than 12% per annum, and the state compensated part of the monthly loan payment.

The program expired on May 31, 2017, while the 4.5 billion rubles allocated for it were already spent as of March.

At the end of July, Russian Prime Minister Dmitry Medvedev signed a decree on the allocation of another 2 billion rubles from the government's reserve fund to the program as a contribution to the authorized capital of the Agency for Housing Mortgage Lending (AHML), and on August 11, a decree specifying the conditions for implementing the program. According to the government, the allocated funds will allow restructuring at least 1.3 thousand mortgage loans.

The main innovation of the updated state assistance program is that only holders of foreign currency loans can use the program. The government and banks explain this very simply: the first wave of the program was aimed at supporting holders of ruble loans, now it's the turn of foreign currency loans.

AHML again acts as the operator of the program to help borrowers this year.

Borrowers who have passed at least 12 months from the date of obtaining a mortgage loan to the date of filing an application for restructuring, and whose monthly loan payment has increased by at least 30%, will be able to take part in the program.

The mortgaged housing must be the only housing of the mortgagor's family. At the same time, the total share of his family members in the ownership of no more than one other residential premises is allowed in the amount of no more than 50% from April 30, 2015.

This money will be spent on mortgage restructuring for those borrowers who find themselves in a difficult financial situation. According to the calculations of the Russian Ministry of Construction, this money will be enough for at least 1,300 families.

The same Ministry of Construction will create a special commission that will consider incoming applications for restructuring and will have the authority, for example, to increase the amount of compensation to borrowers in some cases.

What does all this mean

The program of assistance to mortgage borrowers from the state was launched in the spring of 2015, against the backdrop of the financial crisis, which became especially acute at the end of 2014. Then, after the sharp collapse of the ruble, foreign-currency mortgages suffered the most, whose monthly payments in ruble terms suddenly doubled. But it was not easy for the ruble mortgage holders, who, like everyone else, experienced a drop in living standards, and sometimes a significant loss in income.

The current situation was abnormal, and especially problematic cases needed to be urgently resolved somehow. The mass bankruptcy of mortgage lenders was unprofitable for anyone, including banks. In the end, the bank can take away the apartment and drive people out into the street, but what's next? Firstly, it is one thing when such cases are isolated, and another when thousands of them arise throughout the country, which will cause an unstable social situation and unrest. Secondly, the selected apartments still need to be sold somehow, otherwise they will hang on the banks like a dead weight, and the bank will also be obliged to make various payments for them as the owner.

As a result, the mortgage restructuring program was launched for the following categories of mortgage holders:

  • Parents and guardians of minor children.
  • Parents and guardians of children with disabilities.
  • People with disabilities.
  • Combat veterans.
  • Participants of the state program "Young Family".

It is not enough to belong to any of these categories, it was necessary to prove with documents in hand that the family's income fell by 30 percent or more after the moment when a loan was taken to buy an apartment. The housing itself also had to meet certain requirements.

Those who fell under these conditions were entitled to compensation from the state up to 20 per cent the cost of the apartment (but this amount could not be higher than 650 thousand rubles).

What happened to the restructuring in 2017

A rather ugly story happened to the mortgage assistance program in the spring of 2017. 4.5 billion rubles were allocated for the program, and in February, due to low interest in it, the AHML budget had enough most of this amount, the program was supposed to end by March 1. The state decided to make the conditions even more interesting in order to distribute this money to the end.

The program was eventually extended until May 31, and it was already possible to compensate 30 percent the cost of the apartment (but not more than 1.5 million rubles). At that moment, the unexpected happened.

Mortgage providers, who had been hesitant to take advantage of the restructuring for a long time, rushed to apply en masse, as a result, the program was curtailed already in the first days of March (recall that it was extended until the beginning of summer), and many mortgage lenders found themselves in a very unpleasant situation.

The fact is that in order to use the program, people had to collect certain documents. And since the state informed everyone that the restructuring was valid until May, not everyone rushed to use the new conditions of the program on the very first day, and as a result, by the time the money ran out, a very large number of families remained at the stage of processing expensive documents. Many thousands of rubles were given away for nothing.

What should mortgage lenders do now?

Obviously, 2 billion rubles is not such a large amount, and the money can fly away as quickly as it happened in the spring. Therefore, we advise mortgage lenders who are eligible for restructuring not to hesitate, but to start filling out an application. Those who filed documents in the spring should check the validity of all certificates, and if some of the documents already exist, and these papers are valid, use their advantage over those who need to collect a package of documents from scratch.

Judging by the experience of March 2017, it is not worth delaying in order to take advantage of the mortgage restructuring with the help of the state.
