1. Methodical recommendations were developed on the basis of Chapter 28 of the Code of the Russian Federation on Administrative Offenses (hereinafter - the Code) and determine for the customs authorities of the Russian Federation the procedure for receiving, recording and considering materials, messages, statements received by the customs authorities of the Russian Federation, the absence of an event of an administrative offense (hereinafter - information about the AP).
2. In the methodological recommendations, an administrative offense (hereinafter referred to as AP) is understood as an action (inaction) of an individual or legal entity, for which the Code establishes administrative responsibility, for which customs officials are authorized to draw up a protocol on AP and conduct an administrative investigation.
3. The basis for recording the materials, messages, statements received by the customs authorities of the Russian Federation is the presence in them of data containing real, specific and definite information about the circumstances of a possible accident (about the place, time and method of its execution).
4. Subject to accounting:
received from law enforcement agencies, as well as from other government agencies, bodies local government, from public associations materials containing data indicating the presence of an accident;
messages and statements of individuals and legal entities, as well as messages in the media (hereinafter referred to as the media) containing data indicating the presence of an accident.
5. The principles of acceptance, accounting and consideration of information about the AP received by the customs authorities are the obligatory receipt and accounting, legality, timeliness and objectivity of consideration.
6. Information about the AP received by the customs authority is registered in accordance with the established procedure.
7. When individuals apply with an oral statement containing data indicating the presence of an accident, an official of the customs authority draws up a protocol of the statement on the commission of an administrative offense (Appendix 1). The protocol is signed by the applicant and the official who accepted the application.
When individuals apply with an oral statement containing data indicating the presence of an accident incident to the customs authority during non-working hours, the registration of the protocol of the application for the commission of an administrative offense is carried out by the operational duty service of the customs authority.
8. The collection and analysis of messages containing data indicating the presence of an accident, published or disseminated in the media, is carried out at the customs by the customs press secretary or other official appointed by the head of customs, in the area of which the legal address of the media is located.
9. The information about the AP received by the customs authority after registration or after its identification at one of the stages of work with documents, as well as information about the AP, adopted in accordance with paragraphs 7-8 of these methodological recommendations, is immediately reported by the relevant official of the customs authority to the head of the customs body or his deputy for law enforcement work (in the regional customs administration (RTU), the first deputy head of the RTU for law enforcement work - the head of the operational customs) or persons replacing them, who give a written order to consider materials, messages, statements containing data indicating the presence of an accident (hereinafter referred to as the instruction) (Appendix 2).
10. The official who is entrusted with the consideration submits information about the AP to the structural unit specified in paragraph 11 of these methodological recommendations for accounting, and also timely submits to the employee responsible for receiving and recording information about the AP, maintaining and storing a log of materials, messages , statements of administrative offenses (hereinafter referred to as the journal) and consideration materials (hereinafter referred to as the responsible officer) the data required to fill out the journal.
11. Accounting of the received information about the accident is carried out:
in the Federal Customs Service - the Office of Customs Investigation and Inquiry (UTRD) (paragraph as amended;
at RTU and operational customs - by the registration and registration department of operational customs;
at the customs - by the registration and registration department of the customs.
12. Responsibility for organizing the reception and recording of information about the accident in the customs authorities of the Russian Federation rests with the deputy head of the customs authority for law enforcement, who determines the responsible officer.
13. Upon receipt of information about the AP, the responsible employee takes it into account by entering data into the log and affixing the account number, the date of registration on the appropriate media.
14. Filling in the columns of the journal is carried out in accordance with the form given in Appendix 3.
15. Column 1 indicate the serial registration number assigned to the information on the AP received by the customs authority.
The account number consists of the following digital designations:
the digital code of the customs authority, in which the information about the AP received by the customs authority is registered (according to the classifier of the customs authorities);
the serial number for the magazine, starting from the 1st in each year, with the addition of the letter - And;

16. Column 2 - the date of receipt of information about the AP to the customs authority and the incoming registration number.
17. Column 3 - brief information about the person who provided information about the AP: last name, first name, patronymic natural person; name and address of the legal entity.
18. Column 4 - basic information contained in materials, messages, statements.
19. In column 5 - the position and surname of the customs official who appointed the consideration of information on the AP.
20. Column 6 - the date of appointment of consideration of information about the AP.
21. Column 7 - the position and surname of the customs official in charge of reviewing the information on the AP.
22. Column 8 - information on the extension of the terms of consideration of information on the AP: grounds for extension, position and name of the customs official who extended the consideration, until what time the consideration was extended.
23. In column 9 - the date of registration and the serial registration number assigned to the initiated AP case or criminal case and the qualification of the offense under Article of the Code or the Criminal Code of the Russian Federation, respectively.
24. In column 10 - the date of issuing a ruling on refusal to initiate an AP case, clause number of Article 24.5 of the Code.
25. In column 11 - the outgoing registration number of the message on the detection of signs of other offenses that are not attributed to the competence of the customs authorities, and to whom specifically it is directed.
26. The journal is kept in UTRD, operational customs, customs.
27. The magazine starts from the beginning of the year, front side its cover is drawn up in accordance with the form given in Appendix 4.
28. Sheets of the magazine should be numbered and laced. A sticker with an imprint of the seal of the customs authority is made on the knot of lacing the sheets on the last page, while an attestation inscription must be made on top (Appendix 5).
29. All entries in the journal are made with ink (paste) in blue, purple or black.
30. The log does not allow erasures, corrections or deletions of previously made entries using corrective means.
31. If necessary, entries made by mistake shall be crossed out with a single line so that the previously written text is clearly readable. A new entry is made in the same column. In the "Note" column, the customs officer responsible for keeping the journal makes an appropriate entry, for example; "Corrected in gr. 3 and gr. 5". Provides signature, initials, surname, date.
32. If one journal is not enough to record information during a calendar year, a new journal is started, which is a continuation of the first. At the same time, the number of volumes (volume 1, volume 2, etc.) is put on the cover of the magazines.
33. At the end of the year, a record is made in the journal about the total amount of registered information.
34. Logs and materials of consideration of information about the accident are stored in the subdivision of the customs authority specified in paragraph 11 of these guidelines for three years following the year of their registration, after which they are destroyed according to the act in accordance with the established procedure.
35. In the event of initiation of a criminal case on smuggling or other crimes, the investigation of which is within the competence of the customs authorities, as well as when sending to the prosecutor or the preliminary investigation bodies materials containing information about other crimes, from documents that are evidence in cases of AP, copies are made in accordance with the procedure established by the FCS of Russia (paragraph as amended by the letter of the FCS of Russia dated September 21, 2004 N 01-06 / 1040.
36. For the materials received during the examination, not attached to the AP case or the criminal case, copies of documents taken in accordance with paragraph 35 of these methodological recommendations, internal inventories are drawn up, they are systematized, numbered, filed, and then deposited with the responsible to the employee.
37. In this case, it is obligatory to design the cover of the case (volume of the case). On the cover of the case (volume of the case) indicate: the name of the customs authority, the registration number, the name of the person in respect of whom the information on the AP is being considered, the volume number, the number of volumes of the case, the date of receipt of the information, the date of the decision on it, the number of sheets in the case ( volume), storage period.
38. The storage conditions of the journal and materials must ensure their safety. Familiarization of officials of the customs authority, with the exception of the head of the customs authority or his deputy for law enforcement, with the magazine and materials should be carried out in the presence of the responsible officer.
39. Magazines and materials are documents of internal use and cannot be transferred or issued to organizations, individuals or officials, with the exception of cases stipulated by the legislation of the Russian Federation.
40. If the received materials, messages, statements contain sufficient data indicating the existence of an accident, the official of the customs authority, authorized to draw up protocols on the accident and conduct an administrative investigation, initiates a case on the accident.
41. If the received materials, messages, statements contain data indicating the presence of an AP event committed after the release of goods in accordance with the customs regimes of export, release for free circulation, re-import, as well as after the termination of other customs regimes in relation to goods and Vehicle, consideration of information on the AP is carried out in accordance with the procedure for conducting customs control after the release of goods and vehicles established by the FCS of Russia (paragraph as amended by the letter of the FCS of Russia dated September 21, 2004 N 01-06 / 1040.
42. In other cases, consideration of information about the accident is carried out on behalf of the head of the customs authority or his deputy for law enforcement by the structural divisions of the customs authority, taking into account their competence. An approximate distribution of the competence of the structural divisions of the customs authority in the part related to the consideration of information on the AP is given in Appendix 6.
43. In the FCS of Russia, the consideration of information about the AP is carried out by the UTRD, and on behalf of the management of the FCS of Russia - by another structural unit (paragraph as amended by the letter of the FCS of Russia dated September 21, 2004 N 01-06 / 1040.
44. The composition of the staff involved in the review of information on the AP, the timing of the review shall be established by the customs official who appointed the review, taking into account the specific tasks of the review and the nature of the information received.
45. The terms of consideration should not exceed the time limits established for the consideration of appeals of individuals and legal entities, deputies. If the consideration is carried out on behalf of a higher customs authority, the issue of extending the time frame is agreed in advance with the authority that appointed it.
46. When considering information about the AP, a customs official has the right to use the forms, methods, means of customs and currency control established by customs and currency legislation.
47. If the information about the accident, published or disseminated in the media, contains data indicating the presence of an accident that took place in the area of activity of the customs authority, other than the one given in paragraph 8 of these methodological recommendations, the employee reviewing the information about the accident performs possible actions to establish the presence or absence of an accident accident and, if necessary, sends all materials for consideration to the appropriate customs authority, where they are subject to registration and review in accordance with the procedure established by these methodological recommendations.
If messages published or disseminated in the media contain data indicating the presence of an accident that took place in the area of activity of several:
customs office of RTU, materials of consideration are sent to the corresponding RTU;
RTU, consideration materials are sent to the FCS of Russia (paragraph as amended by the letter of the FCS of Russia dated September 21, 2004 N 01-06 / 1040.
48. The official of the customs authority who carried out the examination makes the following decisions:
upon detection of an accident, initiates an accident case;
upon establishing, in the course of consideration of information about the AP, circumstances precluding the proceedings in the case of the AP (Article 24.5 of the Code), makes a reasoned ruling on the refusal and initiation of an administrative offense case;
if there are signs of smuggling or other crimes, the investigation of which is within the competence of the customs authorities of the Russian Federation, the issue of initiating a criminal case is decided in accordance with the criminal procedure legislation of the Russian Federation;
upon detection of signs of other offenses not attributed to the competence of the customs authorities, reports the available data on jurisdiction.
49. If, in the process of considering information about the AP, circumstances excluding the proceedings on the case (Article 24.5 of the Code) are established, the official considering the information about the AP shall issue a reasoned ruling on refusal to initiate an administrative offense case (hereinafter referred to as the ruling) in the form, given in Appendix 7.
50. The determination is subject to agreement with the head of the structural unit of the employee who issued the determination, and approval by the official who appointed the examination.
51. The definition, together with the materials of consideration, is submitted for accounting to the structural unit specified in paragraph 11 of these methodological recommendations.
52. Control over the legality, validity and timeliness of decisions made based on the results of consideration of materials, messages, statements containing data indicating the presence of an accident is carried out by the head of the customs authority or his deputy for law enforcement.

According to the seismological stations in Norway, Finland, Sweden and Poland, the epicenter of the Kaliningrad earthquake was in the sea 20 kilometers from the northern coast of the Sambia Peninsula. The decrease in energy went quickly, but the damping shocks were recorded for another day. The radius of audibility of the Kaliningrad earthquake by the first and second aftershocks was more than 200 kilometers. Echo reached Germany, Poland, Lithuania.
Houses could not resist, beaches ... increased
Official data says: 2,100 buildings were damaged in Kaliningrad and the region, cracks appeared on the walls and ceilings, plaster crumbled, chimneys collapsed. 20 people were seriously injured, one died of a heart attack. Plummeted Atmosphere pressure- up to 748 millimeters, a squally wind has risen, with thunderstorms and rain. Moisture condensation was like an eclipse of the sun. People poured into the streets, and some citizens threw themselves out of windows in panic and broke their legs. Kaliningraders were afraid to enter their houses and spent the whole night in the courtyards, burning fires, some left the city in panic.
The most violent destruction were on the coast of the Baltic Sea. In the nine-storey building of the sanatorium "Yantarny Bereg", window panes shattered. Opposite the sanatorium itself, the seabed raised, as a result of which the beach from 5 to 20 meters wide before the earthquake, after which it increased to 30-70 meters.
In a kilometer of Svetlogorsk, a 20-meter high railroad embankment was destroyed to the ground for more than 60 meters. Rails with sleepers hung in the air.
The total damage amounted to over 160 million rubles.
There are still no seismic stations
The Kaliningrad earthquake shocked not only the inhabitants of the west of Russia, but also the scientific world of Europe. Extreme, extremely rare for our region natural phenomenon, no one expected, and could not predict - we did not have seismic stations. Immediately after the cataclysm, the scientists of the Russian State University (the current IKBFU) strongly recommended building modern seismic stations in the region capable of detecting earthquake precursors. However, no money has yet been found for this important project ...
Nobody officially allocated funds for the installation and operation of stationary seismic stations, - says Doctor of Geological and Mineralogical Sciences, Professor Vyacheslav Orlenok.- Every year since 2004, I have submitted projects, but they were not even considered. In ten years, we would have already collected statistics, thanks to constant seismological observations to predict earthquakes. To do this, you need to put a food stock, a sea level meter, and a seismic station next to it. The fact is that when earthquakes occur, the capacity of the Baltic Sea changes immediately. Therefore, the coincidence of these changes in sea level and the seismic station records allow us to solve the problem of predicting such natural disasters in our region and save thousands of people caught by the elements by surprise. We live in darkness now.
According to Orlenok, a few years ago, 10 of the latest American seismographs with coordination by space satellites were purchased. One device was installed in the Pravdinsk region, the other - in the region of the Rybnoye settlement, in the basement of the IKBFU training base near Svetlogorsk. But eight seismographs are still in stock. For the system to work as it should, a network is needed, an integrated hydrometeorological station and a magnetometer are needed. This device measures the state of the magnetic field, which changes with the change in the capacitance of the Baltic Sea basin. The creation of a system of "seismic safety" in the Kaliningrad region required about 15 million rubles, but, alas.
It should be added that after the earthquake in 2004, they still made a map of the seismic microzoning of Kaliningrad. The center of the city, areas adjacent to Pregolya and islands fell into the zone of dangerous shocks.
However, scientists reassure - earthquakes of this magnitude occur with an interval of 50-100 years. While you can relax.

The elephant of Pregolya, for no reason at all, began to beat her feet against the walls of the cage, then she ran out into the air and trumpeted three times. A moment later, the land near Kaliningrad was shaking ... The next day after the tremors, having survived the stress, Pregolya calmed down.
It should be added that last summer they decided to use Pregolya as a football expert. With the help of a basket of apples, she was asked to predict the outcome of the Russia-Belgium match at the World Cup. Pregolya put on 3: 0 in our favor, but she made a serious mistake - we lost 0: 1.

Disputes about seismic shocks in the Kaliningrad region are still ongoing. Both Russian and Belarusian specialists took part in the study of the unique natural phenomenon.The seismic surge in the Kaliningrad region in 2004 surprised not only residents, but also the expert community.
Scientists from the Institute of Physics of the Earth RAS (IPE RAS) investigated the causes and consequences of this geophysical event. In big teamwork seismologists from the National Academy of Sciences of Belarus participated, continuing to exchange information and prepare joint publications with Russian colleagues.
By the way, the first data on the unique earthquake were obtained, among other things, from a seismic station located on a granite shield in western Belarus. Full-fledged reconstruction, according to the head of the seismologists group, Doctor of Geological and Mineralogical Sciences Andrei Nikonov from IPE RAS, became possible precisely thanks to the deployed hardware network in the salt mines of the Union State.
So, on September 21, seismic stations recorded three shocks - at 11.05, 13.32 and 13.36 GMT. The complete surprise of the event and the lack of preparedness of the residents for such events raised a lot of questions.
We have at least 30 publications on the Kaliningrad earthquake, on various aspects, including an assessment of the future seismic hazard, ”notes Andrey Nikonov. - Belarus, the Baltic states were strongly affected, - says the scientist, - as a result, maps were built for each of the aftershocks, which also affect the territory of Poland.
The Kaliningrad earthquake was purely tectonic, it is typical in literally all manifestations, experts say: no artificial factors were found. The well-known seismologist Felix Aptikaev (IPE RAS), who left for the region immediately after the earthquake, notes that "the intensity of the earthquake can be estimated at 6.5 points."

Felix Aptikaev claims that the epicenter of the earthquake was on the Baltic shelf:
- Sailors from ships saw how the water boiled in this area, - says the scientist, - even a small tsunami rose.
Aptikaev cited curious facts preceding the event and associated with the unusual behavior of animals. For example, a female elephant in the Kaliningrad zoo a few hours before the earthquake, turning to the enclosure, began to beat on the fence, trying to get out.
These and other data confirm the special sensitivity of the animal world to natural phenomena. Seismologists around the world have long been interested in the response of animals to the intensity and changes of electromagnetic pulses that occur in rocks under stress. Many modern researchers are engaged in this topic, including Professor Motodozi Ikeya from the University of Osaka, who recently released a generalizing monograph “Earthquakes and Animals”.

After working through written sources, Andrei Nikonov notes that “a similar explosion of seismic activity took place in this region 700 years ago, in 1302”. He cites references to a medieval chronicler who went down in history under the name of Peter of Duisburg (15th century), who wrote about the "terrible trembling" of the earth. Then, in 1328, old houses were threatened with collapse in Memelburg (now - Klaipeda). And even earlier, in 1302, "in the Prussian land", or rather in the Curonian Lagoon, "a miracle appeared." When the army of the German order passed in the fall of thin ice bay, the ice suddenly began to rise and fall, "like water in a storm", and people on the ice "either climbed on the ice as if on a mountain, then sank as if into an abyss."
There are also earlier reports of strong movements of the earth's surface in the vicinity of present-day Kaliningrad, dating back to the 6th century. From this, one can make assumptions about the interval of such events, which are significant for long-term expectations and for seismic zoning maps and, especially, for strategic objects, sums up Andrey Nikonov. And it reminds us that joint research of Russian and Belarusian scientists in this and related topics of modern geophysics continues.
