Under what conditions can they be expelled from the university. The Ministry of Education warns: why are they expelled from a university or college? Valid reasons for expulsion from the university

The procedure for exclusion from a higher educational institution is unpleasant for both the administration and the student. For management, this is a long, laborious process that requires the preparation of a long list of documents and strict adherence to the procedure for expulsion from the university established by law. The very culprit of the emergency will also have to go through not the happiest moments in life, so it’s better not to bring the situation to a boiling point and know exactly what they can be expelled from the university for.

According to the 61st article of the Federal Law on education, there are two grounds for expulsion from a university: the initiative of a higher educational institution and the desire of a student if he:

  • decided to transfer to another university;
  • changes residence;
  • unable to continue their studies due to family (life) circumstances or due to poor health.

At the suggestion of the university, this is always an exception for disrespectful reasons, which are considered:

  • Non-payment. Contract students of full-time and part-time departments should be especially careful and control the terms within which they need to pay money for education. For one day of delay, of course, they will not be excluded, but if you do not respond in a timely manner to the notice of the dean's office about the need to pay off the debt and do not make a contribution, deductions from the university for non-payment cannot be avoided.
  • Poor progress. This wording takes effect if there are three academic debts in one or more subjects:
    • undelivered tests, exams;
    • two unsuccessful retake attempts;
    • the expiration of the term for the liquidation of "tails" - usually the first 30 days after the summer holidays or the winter session.

Failures in coursework or practice also refer to debts.

The rules for expulsion from a university for poor progress on the basis of the Model Regulations on an educational institution of higher professional education are drawn up by all universities, institutes, colleges, academies independently and are prescribed in the charter, so the timing and number of retakes, the periods for paying tuition fees may vary.

The application of disciplinary measures, which include expulsion, according to the 6th part of the 43rd article of the law on education, is unacceptable during academic leave, illness and holidays.

  • Other reasons. These include:
    • violation of the internal regulations of the university;
    • untimely exit from academic leave;
    • unjustified absence from examinations;
    • hooligan behavior in hostels or educational buildings;
    • imprisonment.

Paid students can be expelled when they violate the terms of the contract.

If the expulsion occurs at the request of the student, it is necessary to write an application addressed to the rector, which will be considered within a period not exceeding 10 days. The student is considered officially expelled only after signing the order.

Be careful! At paid departments, tuition fees are charged until the expulsion order is issued, even if the student does not attend classes.

If the initiator of the exclusion is a university, then the administration must first request a written explanatory letter from the student. Failure to provide information about the reasons for underachievement, payment arrears, non-attendance, or unwillingness to explain other circumstances that forced the educational institution to raise the issue of student status does not prevent expulsion.

If there are no satisfactory, valid explanations or there are good grounds for disciplinary action, the dean of the faculty sends a reasoned idea of expulsion to the rector's office. Within three days, it is signed by the head of the university and transferred to the student personnel department, where the corresponding order is issued.

What documents are issued to the expelled student

In exchange for a bypass sheet signed in the library, utility block, hostel, the ex-student receives his school certificate and all original documents provided upon admission. When transferring to another educational institution, an academic certificate will be required, which lists the completed courses, indicating the number of hours taken and the grades received.

It is extremely rare for a student to be expelled without the right to reinstatement, and almost never instantly. There is always time and a chance to correct the situation.

Student years are perhaps the most fun and carefree. They are remembered for a lifetime, because it is during this period that a person takes his first independent steps in adulthood, learns something new, makes new acquaintances. But this is also the most difficult time, because all decisions must be made independently, problems must be eliminated, and most importantly, one must be very disciplined.

It is full of temptations that are very difficult not to succumb to, so often for a student everything ends before it even starts, because he will be expelled from the university for misconduct. As you know, therefore, excuses like “I didn’t know”, “I won’t do it again”, etc. will not work. For this reason, each student is simply obliged to understand not only his rights, but also his obligations.

Firstly, expulsion from the university is possible at will. For example, a student is tired of studying, he realized that he chose the wrong profession or wants to transfer to another educational institution. If the training takes place on a contractual basis, then you can be expelled for any violation of the contract.

Non-payment of tuition can also be a good reason for the university to strike the student out of its ranks. In most cases, universities make concessions to their students by postponing payment terms. But only if a sufficiently strong explanation is provided for the reason why payment cannot be made on time. If all the deadlines are ignored, then the educational institution has every right to expel the student.

It also does not hurt to read the charter of the university, since violation of its rules may result in expulsion from the university. Many reputable institutions, in order to preserve their reputation, expel negligent students who behave inappropriately not only within the walls of the educational institution, but also in their free time. Any misconduct is subject to disciplinary action, up to and including expulsion.

Any student can take academic leave. The reason may be pregnancy, illness of parents, the need to earn money to pay for education, etc. So you need to return from academic leave within the agreed time, since any delays can lead to expulsion. If a student is on a business trip abroad and cannot start studying on time, then it is necessary to submit certain documents confirming this fact.

Expulsion from the university is also possible with academic debt, if during the session the student did not pass more than three disciplines. One of the most common reasons is the huge number of absenteeism. Enjoying freedom, a student may not go to class because he overslept, suddenly had a headache, or simply is not in the mood. Expulsion from a university is also possible for damaging university property, appearing in an educational institution in a state of gambling, inappropriate behavior in a hostel, etc.

The procedure for expulsion from the university involves the issuance of an appropriate order on the basis of a personal statement of the student, if he leaves of his own free will, or on the basis of the dean, in which the reason is indicated. The student draws up and submits it to the dean's office along with a student card. At this study at this university for him ends.

Expulsion from a university is a fairly common practice of punishing students. The most common reason is failure. This threatens both state employees and students on a paid basis, numerous warnings from the dean's office in such a situation are not something mandatory. In addition, restoring at a university after being expelled for poor progress is not an easy task, because your reputation and status as a “slob”, “truant” and “loser” have already been tarnished.

The main reasons for expulsion from the university

All of them can be divided into respectful and disrespectful. In the first case, this is one's own desire, transfer to another university, medical reasons. Disrespectful include:

  • academic failure;
  • systematic absenteeism (they either directly lead to expulsion, or they lead to academic failure);
  • violation of the rules of the order and charter of the educational institution.

Expulsion for poor performance from the university

The abundance of unclosed "tails" or in the language of the dean's office "non-fulfillment of the curriculum" is the most common reason for expulsion.

Problems of this kind are possible if:

  • three or more disciplines are not “closed” in one session (there are deuces or there is no access to the exam);
  • one subject of the attestation commission was not passed (taking into account two retakes);
  • the academic difference is not “closed” (when changing specialty);
  • debts are not delivered within the terms established by the dean's office;
  • practice has not been completed (the necessary reports on its completion have not been provided).

Usually, debts roll in like a snowball, and at the end of the semester, a surprised student learns that soon he will have to join the army or look for a job, because he will not be able to study here anymore. The easiest way is to prevent such a situation in advance, approach teachers in problematic subjects, and if necessary, order coursework online from us in order to gain access to the session.

What to do after graduation from the university?

If it was not possible to avoid trouble, then you need to understand what to do next.

The Ministry of Education warns: why are they expelled from a university or college?

The procedure for expulsion from the university is quite simple, the dean's office informs, explains the reasons, issues an academic certificate that confirms the fact of passing the training and contains information about all the subjects passed with grades.

Recovery after expulsion for academic failure is one of the rights of an ex-student. In this case, it will no longer be possible to be on the budget again. Restoration occurs for the same course, if all "debts" are closed, or for the previous course with the need to re-take already learned material.

It is also possible to enter another university after expulsion with the need to pass the academic difference - to close those subjects that were taught in the previous year at this educational institution, but you did not study them at the previous place of study.

We are also ready to help with recovery, namely the closure of debts and the surrender of the academic difference. With us you can write an essay to order, term papers, test papers to order, etc. In most cases, this is exactly what is required for debt repayment and recovery.

The expulsion of a student from a higher educational institution is a procedure that is best never to go through, but, nevertheless, it is required to be well represented to each student.

expulsion from the university for poor performance

It should be noted right away that the expulsion of a student is a phased process that must be carried out in accordance with applicable law. When making a decision to exclude a student from the ranks of students, the rights and interests of both a citizen and a higher educational institution should be taken into account.

The issue of expelling a student at the initiative of the administration of an educational institution is considered by a special educational commission.

There are several reasons why a student may be expelled from a university, which can be divided into two groups:

  • The student's own desire, which may be caused either by a transfer to another educational institution, or by a decision to graduate, or for other reasons;
  • The initiative of the university management, due to the non-fulfillment of the curriculum, including low academic performance or failure to eliminate the current academic debt; gross violation of the provisions of the charter and internal regulations of the university; low attendance without good reason; Failure to attend exams for no reason. Absence from academic leave, the presence of gross disciplinary violations, as well as, in the case of studying on a commercial basis, arrears in tuition fees or violation by the student of other terms of the contract may also serve as a reason for expulsion.

Let's now deal with the mandatory procedures for expelling a student at the initiative of the university administration.

When a student is expelled for non-compliance with the curriculum or for academic failure at the initial stage, the dean of the faculty prepares a reasoned submission on the student's expulsion indicating the reason for the expulsion and the date of expulsion, which he signs with the rector (vice-rector) within 3 days and submits to the student personnel department for issuance of a withdrawal order. The student must be familiarized with the submission against signature.

The expulsion of students for violation of duties stipulated by the internal regulations, and other gross disciplinary violations, is determined by the Order of the Ministry of Education and Science of the Russian Federation N 185 adopted on March 15, 2013, the procedure for applying to students and removing students from disciplinary measures.

According to this procedure, before applying a disciplinary sanction, the administration of the university must request a written explanation from the student. If, after three school days, the specified explanation is not provided by the student, then an appropriate act is drawn up. It should be noted that the student's refusal or avoidance of providing a written explanation is not an obstacle to his expulsion from the university. An entry of the following nature is entered in the expulsion order: “expelled from the student body (full name is indicated), course number, specialty, form of study” and the basis and date of expulsion are prescribed.

Next, the student should sign the bypass sheet. This will require visiting several services of the educational institution, including the economic unit, library, etc. Only by presenting a signed bypass sheet, the student will be able to get back the original documents on basic education (as a rule, this is a certificate of complete secondary education). The record book is also handed over by the student and, together with an extract from the order of expulsion, is stored in the archive of the educational institution.

In addition, a former student can write an application for a standard certificate of study at a university (academic certificate), which records the fact of incomplete higher education.

In the event that a student for some reason cannot appear for documents, this can be done by an authorized person (with a notarized power of attorney), or his legal representative (if the student has not reached the age of majority).

The procedure for expulsion from the university

Dismissing a student from an educational institution is a complex process. This causes a large number of problems, both for the student and the management of the educational institution. There are a variety of reasons why a student may be expelled. Often this is due to student failure, non-payment of tuition or non-attendance. In addition, the student may stop studying at this educational institution on his own initiative. The procedure for expelling a student from a university depends on the specific case.

Why can a student be expelled from a university?

16 article The Federal Law on expulsion from an educational institution states that if a student fails to comply with the rules of the university, he has the right to be expelled from the educational institution.

  • Violation of the norms of behavior in an educational institution, as well as non-compliance with the general order;
  • Fake documentation was presented on admission;
  • Violation of tuition fees. In this case, after the student pays the debt, he has the right to continue studying;
  • Inappropriate behavior towards other students or teachers;
  • Frequent absenteeism, as well as poor academic performance, are the most common grounds for expulsion;
  • At the end of academic leave, the student did not come to class;
  • The use of prohibited foods or drinks on the territory of the educational institution;
  • The student came to the university in a state of drug or alcohol intoxication.

Non-attendance

The legislation of the Russian Federation does not provide for punishment in the form of deductions for non-attendance. However, each educational institution has an internal Charter, which states that absenteeism can be regarded as poor progress, for which the university has the right to expel. The charter contains information about the acceptable percentage of non-attendance, often from 3 to 5.

It should be noted that if the reason for absenteeism is valid, the student has the opportunity to avoid expulsion. However, he will need to prove this documented.

underachievement

Academic failure is the student's failure to complete the curriculum for passing the session and passing certification.

A student is expelled for underachievement in the following cases:

  • Did not pass the examination paper in three subjects during the session;
  • If the student after the second retake did not pass the exam with a positive mark;
  • When moving to another faculty, he failed to pass the necessary subjects;
  • Failed to close the debts within the period specified by the educational institution;
  • Did not pass one of the certification papers;
  • The student failed to cope with the study plan presented by the university;
  • I did not cope with the practical part of the training and did not pass the required reports on it.

Valid reasons for expulsion from the university

In addition to disrespectful reasons for expulsion, there are also valid ones that, when expelling, do not affect the reputation of the student and the educational institution.

List of valid reasons for expulsion:

  • Student Desire. If the student has decided that he no longer wants to receive education, or the need to complete his studies is related to family circumstances, he should file an application addressed to the rector;
  • The student was drafted into the army. If the university implements a program to acquire knowledge in the field of military training, the student has the opportunity to continue receiving education in his specialty, combining the main faculty with military courses. As a result, the student receives a rank and exemption from military service;
  • Transfer of a student to another educational institution. There are situations when a student realizes that he has chosen the wrong profession. As a result, he wants to transfer. To do this, they draw up an application addressed to the rector;
  • Based on medical opinion. If, due to a medical condition, the student is unable to continue studying. However, this must be confirmed by the conclusion of the medical advisory commission.

Deduction procedure

  • Employees of the dean's office of the faculty draw up a document that indicates the desire to stop studying by the student, as well as the reason and date;
  • Further, the order is sent to the rector for signature. This should be done within three days;
  • After that, the employees of the dean's office must send the act to the personnel department;
  • A student of an educational institution must familiarize himself with the specified document, as well as sign, confirming familiarization;
  • In addition, the student must sign and submit to the dean's office a bypass sheet, the contents of which include the following: library, contract department, dean's office, methodologist, hostel commandant. After affixing all the necessary signatures and seals, the student will be able to pick up the originals of their documents.

The deduction procedure is completed by issuing an order. To draw up an order correctly, you need to familiarize yourself with the structure of filling out the document:

  • The full name of the educational institution and the location (city) are noted;
  • Title and serial number of the document;
  • Personal information about the student;
  • The name of the faculty and specialty of the student citizen;
  • The form in which the person was educated;
  • Budgetary or contract basis of training;
  • In the main part of the order, personal data and the course number are indicated;
  • The reason on the basis of which the student is expelled from the educational institution;
  • The article of the local regulation is indicated in accordance with which the expulsion process is implemented;
  • At the end of the order, the signatures of the dean of the faculty, the head of the educational department and the vice-rector for educational and organizational part are affixed.

How to appeal against the order of the rector of expulsion from the university?

Situations are not uncommon when a citizen receiving education at an educational institution is subject to illegal expulsion. If there are legal grounds, the student has the right to cancel the effect of the expulsion order.

  • The presence of valid motives for skipping lectures, not passing the session;
  • Deduction in respect of a student who is on sick leave, on maternity leave or during the holidays - is unacceptable under Federal Law number 273;
  • A citizen undergoing training has the right to appeal the expulsion from an educational institution upon discovery of a violation of the procedure for expulsion. For example, if a student has not closed the session, and a second retake guaranteed by law is not provided, he has the right to declare a violation of his rights;
  • The student has the opportunity to challenge the expulsion if the management of the university did not notify the student of the exclusion;

It is possible to appeal against an illegally issued expulsion order if the claim drawn up by the citizen addressed to the rector was not taken into account;

  • If the period during which a student can be disciplined has been missed. The specified period is one month from the moment when the official learned about the fact of the offense.

It is extremely rare for a student to be expelled without the right to reinstatement, and almost never instantly. There is always time and a chance to correct the situation.
