We don’t burn at the dacha!

“Starting a fire” is considered to be the flame from a fire, barbecue, or even from an unextinguished cigarette. Since the beginning of the year, about a hundred administrative cases have been initiated regarding improper lighting of fire. Even in summer cottages during periods of increased fire danger, you cannot have a fire on the veranda. You can also forget about barbecues in the forest, park, square and yard. Now EMERCOM employees are catching violators using quadcopters. Therefore, fire can only be lit in specially designated places; they are found in any park.

How to find and how much do places designated for making fires cost?

These sites can be found in any of the region’s 133 parks. There are more than 1.3 thousand places for bonfires, but sometimes even the staff on site don’t know about their existence. Navigation on the parks' websites is quite confusing. For example, on the Elk Island page there is no information about stationary fire pits. And in order to find out that there are as many as seven sites with barbecues, I had to call the help desk. The rental price, by the way, is quite high. Million fines

For a picnic in the wrong place during a special fire safety regime, fines are doubled. So, in the territory of Moscow and the region they amount to up to 15 thousand rubles from each individual; if the fire turns into a fire, then you will have to pay a million rubles. In addition, money will have to be paid for extinguishing and planting new trees. They may also be subject to criminal liability. Violators are caught using quadcopters. If you cause a fire, you will have to pay for both extinguishing it and replanting the destroyed plants. By the way, driving into the forest by car during the “special regime” is also prohibited.

Carcasses correctly

You may have caused a forest fire more than once, although you don’t even know it. It seems like they doused the coals with water, maybe even buried them, but putting out a fire is a whole science, and improperly soaked logs can set fire to a peat bog, and, as a result, kilometers of trees will burn.

So, we grill kebabs only on the grill. The radius of mineralized soil is a meter (this means that within a radius of 100 centimeters you need to remove the top fertile layer from the ground). After everything is fried and eaten, pour water over the coals. In order to completely prevent fire, you need to pour a couple of five-liter cans of water into the grill. Only after this can you bury the ashes (for this you can use black soil that you “removed” from the ground before).

Such places are determined by decree Decree of the Government of the Russian Federation of June 30, 2007 No. 417 (as amended on August 18, 2016) “On approval of Fire Safety Rules in Forests.” Government of the Russian Federation No. 417 “On approval of fire safety rules in forests.” It is strictly forbidden to make fires and barbecue, including on barbecues:

  • in young coniferous forests;
  • on burnt areas;
  • in areas of damaged forest;
  • in places where felling took place and there are remains of trees or harvested wood;
  • on peat bogs;
  • in places with dried grass;
  • under the canopy of trees;
  • on the territory of nature reserves.

In other places you can make fires. But to do this, you need to equip the site: separate it with a fire-resistant mineralized (cleansed to the mineral soil layer) strip with a width of at least 0.5 meters. It will help stop the fire if it “escaps” from the fire.

A special fire safety regime has been introduced. What does it mean?

The special fire regime involves a complete ban on the lighting of fires in certain areas. The decision to introduce it is made by local authorities. In this case, shish kebab cannot be grilled over an open fire, on a grill, or in a barbecue.

That is, barbecues are prohibited due to hot weather?

Not only. For example, from June 14 to July 15, a special fire regime will be introduced in 11 Russian cities where the World Cup will be held. In Moscow, St. Petersburg, Volgograd, Kazan, Kaliningrad, Yekaterinburg, Nizhny Novgorod, Rostov-on-Don, Samara, Saransk and Sochi, it will be prohibited to cook food over fire or coals.

The ban applies not only to ordinary citizens, but also to organizations. So cafes and restaurants located in these cities will also not be able to cook barbecue outdoors during the championship.

The Ministry of Emergency Situations reports the onset of a certain fire hazard class in forests. What does it mean?

The fire hazard class in forests is determined depending on the weather. The less precipitation and the higher the air temperature, the higher it is. The most dangerous are IV and V fire hazard classes.

During this period, the same prohibitions apply as during the special fire regime. In addition, you cannot drive into the forests by car. If the weather is very hot, access to green areas may also be limited to pedestrians.

In any case, when you drive or go into the forest, look for signs that prohibit making fires. Always follow fire safety rules:

  • clear the fire pit of dry leaves and branches;
  • do not throw unextinguished cigarette butts and ash into the grass;
  • Do not leave flammable objects or trash behind.

What happens if you break the ban?

Article 8.32 of the Code of Administrative Offenses of the Russian Federation provides for those who lit a fire in the wrong place, a fine of 1,500 to 3,000 rubles. If the violation occurred during a special fire regime or a forest fire broke out, but no one was injured, the fine increases to 4,000–5,000 rubles.

For officials and legal entities, the punishment is much more serious: up to a million rubles, depending on the consequences.

The forest is clear. How about a barbecue in the park or in the courtyard?

But in the parks you can have a picnic with barbecue. But only on specially equipped areas with barbecues, if any.

Surely there are no prohibitions at the dacha?

Eat. The rules are determined by a special order Federal Law “Order No. 26 of January 26, 2016 “On approval of the Procedure for the use of open fire and making fires on agricultural lands and reserve lands.” Ministry of Emergency Situations. If you light an open fire, then:

  • the nearest buildings must be at least 50 meters away;
  • to coniferous trees - at least 100 meters;
  • to deciduous trees - at least 30 meters.

For greater safety, the area around the fire must be cleared of dead wood, dry grass, dead wood and debris within a radius of 10 meters and dug in with a mineralized strip at least 40 centimeters wide.

If you use a barbecue or brazier in your garden plot, the permissible distance to the nearest building is only 5 meters, and the area for clearing dead wood and other things is reduced to 2 meters.

Don't forget to keep an eye on the fire. After the kebab is ready, carefully pour or cover the coals with sand or earth.

The penalty for violating the rules is fines. Citizens, depending on the circumstances, may be fined Code of the Russian Federation on Administrative Offenses dated December 30, 2001 No. 195-FZ (as amended on April 23, 2018) (as amended and supplemented, entered into force on May 14, 2018). for an amount from 2,000 to 5,000 rubles.

If the fire you lit led to damage to the forest fund, criminal liability arises. Article 261 of the Criminal Code of the Russian Federation providesCriminal Code of the Russian Federation dated June 13, 1996 No. 63-FZ (as amended on April 23, 2018, as amended on April 25, 2018). for this there is a decent fine - up to 3 million rubles.

I want to put a grill on the balcony of my apartment. Can?

It is forbidden. There is no direct ban on cooking barbecue on a balcony, loggia or roof. But there is a punishment Code of the Russian Federation on Administrative Offenses dated December 30, 2001 No. 195-FZ (as amended on April 23, 2018) (as amended and supplemented, entered into force on May 14, 2018). for violation of fire safety requirements. For a fire that leads to the destruction or damage of someone else's property, you face a fine of up to 5,000 rubles.

Even if you don’t start a fire, but limit yourself to coals, the risk of starting a fire even from one spark is great. So it's better not to take risks. Barbecue is definitely not worth fines, much less criminal punishment.

Summer is the time for barbecue. But not everyone has the opportunity to travel out of town. And in nature, away from the bustle of the city, enjoy relaxation with the wonderful aroma of fried meat. And some people simply don’t have time to travel, to the countryside, to waste time on the road. Or there is no way to escape from a busy work schedule. I would like to barbecue close to home. But the law reduces this possibility to some extent. And for violating fire safety rules when lighting a fire for a barbecue, a citizen is brought to administrative responsibility and a fine is imposed on him, the amount of which is sometimes not small.

How to barbecue without breaking the law? There is no precise definition in federal law indicating what amounts to lighting a fire. This allows for free interpretation of the law. The main laws on fire safety are the Federal Law of December 21, 1994 No. 69-FZ “On Fire Safety”, “On Voluntary Fire Protection” and July 22, 2008 No. 123-FZ “Technical Regulations on Fire Safety Requirements”, Decree of the Government of the Russian Federation “On fire safety regime" dated April 25, 2012 No. 390. Fire safety rules in the forest were approved by a separate Decree of the Government of the Russian Federation dated June 30, 2007.

These documents do not say about direct prohibitions on lighting fires by citizens in populated areas. There are no clear instructions and defining the acceptable limits of places where it is possible and impossible to light an open fire, but instructions of this nature are in the laws of the regional level on fire safety and landscaping. You cannot light a fire near a railway. In forest areas, in warm weather, you can light a fire, but only in areas fenced with a special firebreak.

If a fire is lit in a populated area, its proximity to residential and non-residential buildings must be at least 50 meters. In order to minimize this distance, the use of a barbecue requires administrative permission, which can be obtained by organizations registered as a public catering establishment. But even this permission to light a fire in a barbecue obliges them to use only coals.

If these fire safety requirements are violated, the citizen will be punished with a fine of 1,000 to 5,000 rubles; if this is an official or legal entity, then such a fine will be higher. If a citizen’s violation of fire safety rules results in harm to health, he may pay a fine of 80,000 or be imprisoned for up to 5 years. A possible punishment may be in the form of forced community service. The legislation does not have a precise defining classification by which it would be possible to accurately establish what actions constitute lighting a fire. There is nowhere in the legislation that prohibits the use of barbecues or other devices for heat treatment of food on the balcony. Theoretically, such actions are not prohibited by law.

Few neighbors would like such a picnic on the rooftop balcony. Such actions are very unsafe. Smoke, fumes and soot from the fire will fall into other apartments in the neighborhood. Things may be drying on them, or flammable objects may be lying on them. The slightest spark from such a fire will cause a fire. The smoke that will come from the fire will provoke neighbors to call the fire department and the Ministry of Emergency Situations. Such actions are unlikely to please not only the neighbors in the house above, but also the residents of the neighboring house, on the contrary. Smoke and soot can fly into their open windows, fill their apartments with an unpleasant pungent odor, saturating things and textile upholstery. Or cause a deterioration in general condition and well-being, soot can cause difficulty breathing in some people.

Lighting an open fire indoors carries legal penalties for such actions. The legislation does not stipulate anywhere that a fire in a barbecue, especially if it is lit not with wood, but with coal, is open. But still, if you are caught by representatives of legal authorities or the fire service with a working barbecue, then for such actions you can pay quite a small fine according to the law. In detail, you face the following:

For lighting a fire within a residential area, you face a fine of 100 to 420 rubles;

If, when starting a fire, the property of neighbors was damaged, or this caused a fire in the house, then the participant in such actions faces correctional labor for up to 2 years, and possibly restriction of freedom from 0.5 to 3 years;

If a lighted fire caused a fire or death, then the participant in such actions faces imprisonment for up to 7 years;

If the weather outside is bad and there is no opportunity to go out into nature, but you really want barbecue, then there is a method that you can safely use. And don’t be afraid that the letter of the law will be broken. It is possible with spiral household appliances specially designed for the purpose. This is an air or electric grill, it is absolutely safe and approved for use at home. This, of course, will not be quite a classic kebab, but the option is very acceptable and safe. This household appliance runs on electricity. Usually it is installed in the kitchen, but you can move it to the balcony, or also install it on a special table for cooking, near the outlet, on which the device itself and meat preparations are located.

You can light a fire in the wrong place, in areas not intended for this purpose, as well as on balconies. At the same time, you should be prepared for problems with law enforcement and fire services, and administrative and criminal penalties. But it’s still better to relax in nature, and not be afraid of law enforcement agencies, but act in accordance with the law, then the vacation will be more pleasant, your nerves will be stronger and the barbecue will taste better. Another option is to order a ready-made dish in a restaurant, but as you know, shish kebab is not only a tasty and aromatic delicacy, but also a pleasure from the cooking process itself.

The question of whether it is permissible to barbecue in the courtyard of an apartment building is quite ambiguous from a moral point of view. When you do it yourself, it seems like there is nothing wrong with it. However, when someone else is preparing barbecue under your windows, it immediately causes irritation. This is probably why more often on the Internet people wonder where their neighbors are going, rather than looking for information about how legal it is.

Possible consequences

As such, there are no fire safety rules prohibiting barbecue in the yard. And punishment is threatened only if citizens light an open fire, that is, cook meat over a fire, and not in a grill. Then they may be given a warning or even a fine - from one to one and a half thousand rubles. This can only be done by a police officer, who is usually called by disgruntled neighbors. After their application, an inspection is carried out, on the basis of which a decision is made regarding barbecue lovers.

As such, the police receive virtually no complaints about someone barbecuing in the yard. However, such a vacation is often associated with noisy fun of large companies, and this is another point. In fact, the police have nothing to show against people peacefully roasting meat if they behave quietly and do not drink alcohol. In a situation where they start washing down the shish kebab with beer or something stronger, they can already be brought to administrative responsibility under Part 1 of Art. 20.20 Code of Administrative Offenses of the Russian Federation and issue a fine.

It turns out that frying meat in your yard is a very real possibility. The main thing is to comply with all the necessary requirements.

We barbecue in the yard

There are a lot of recipes for cooking shish kebab. But there is only one way to do it in the courtyard of an apartment building. The first and basic rule: meat must be fried in a grill or some other special structure. Open fire is not allowed. Second: you must be at least seven meters from houses or garages. Third and last: you should have a ten-liter bucket of water, or even better, a small fire extinguisher. If you follow all these simple instructions, you will not face a fine.
In addition, you should carefully ensure that the height of the fire is not more than half a meter. If the wind rises outside, the flame should be extinguished immediately.

Thus, your desire to barbecue in your yard will not meet any restrictions. In any case, legislative ones. But how your neighbors will react to such a situation largely depends on your relationship with them.
